Welcome to Zyvera Nail! Zyvera Nail is a brand operated by Zyvera LLC, a Wyoming limited liability company. The terms “we,” “us,” and “our” refer to Zyvera LLC, doing business as Zyvera Nail.

Zyvera Nail operates this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience collectively referred to as the “Services.” Zyvera Nail is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein, constitute these “Terms of Service” or “Terms” and describe your rights and responsibilities when you access or use the Services.

Because many Zyvera Nail products feature handmade or individually placed decorative elements, minor variations in placement, color, texture, or appearance may occur. These minor variations are not necessarily defects.

Product measurements are provided to help customers select an appropriate size. Customers are responsible for reviewing the applicable size guide and measuring their natural nails before ordering.

We do not guarantee that the appearance of a product on your device will be identical to its appearance in person.

Product descriptions, availability, and specifications may be updated without prior notice. We reserve the right to discontinue products and to limit quantities offered to any person, geographic region, or jurisdiction when reasonably necessary.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Zyvera Nail reserves the right to accept or decline an order for legitimate business, payment, fraud-prevention, inventory, legal, or fulfillment reasons.

Your order is not accepted until we confirm acceptance and successfully process the applicable payment. Please review your order, shipping address, size, and product selection carefully before submitting it.

We may be unable to accommodate cancellation or modification requests after an order has entered processing or fulfillment.

If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing information, shipping information, or phone number provided with the order.

Prices, discounts, and promotions may change without prior notice. The price charged will be the price displayed when the order is submitted, subject to correction of clear technical or pricing errors.

Unless expressly stated otherwise, listed product prices do not include shipping charges, taxes, customs duties, import charges, or other government-imposed fees.

The complete amount payable by the customer will be displayed during checkout before the order is submitted.

Prices displayed through our online store may differ from prices available through third-party platforms or promotional channels. Promotions may be subject to separate conditions. If promotional conditions conflict with these Terms, the specific promotional conditions will govern that promotion.

Delivery dates and transit times are estimates and are not guaranteed. Delays may result from carrier operations, severe weather, customs processing, peak-season volume, address problems, security inspections, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an address error. Address changes cannot be guaranteed after fulfillment has begun.

Nothing in this section limits our obligations under applicable law or the remedies available under our Shipping Policy and Return and Refund Policy for packages that are lost, damaged, defective, incomplete, or incorrectly fulfilled.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their content, including trademarks, brand names, text, graphics, product images, photographs, videos, audio, product descriptions, logos, icons, designs, and arrangements, are owned by Zyvera LLC, its licensors, or applicable third parties and are protected by United States and international intellectual property laws.

Shopify’s names, logos, products, designs, and slogans are trademarks of Shopify. Other names and marks appearing through the Services belong to their respective owners.

The Services may provide access to tools or functionality offered by third parties. We may not monitor or control those tools.

Zyvera Nail is powered by Shopify, which provides technology used to operate the Services.

Sales made through our store are transactions directly between the customer and Zyvera LLC, doing business as Zyvera Nail. Shopify is not the seller of Zyvera Nail products and is not responsible for fulfilling customer orders.

To the extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not responsible for injury, damage, loss, disputes, or other claims arising from products purchased directly from Zyvera Nail.

  5. The Feedback does not contain viruses, malware, or harmful code.

We reserve the right to correct errors, update information, or cancel an affected order when reasonably necessary, including after an order has been submitted.

If we cancel a paid order because of an error, we will issue an applicable refund to the original payment method.

  4. Content or Feedback submitted by you that violates these Terms or another party’s rights.

We will provide reasonable notice of an indemnifiable claim. A delay in notice will not relieve your obligations unless the delay materially prejudices your ability to respond.

We may control the defense and settlement of a claim, but we will not agree to a settlement requiring non-monetary obligations from you without your reasonable consent.

SECTION 19 — SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Wyoming and applicable federal laws of the United States, without regard to conflict-of-law principles.

To the extent permitted by applicable law, legal proceedings arising out of or relating to these Terms or the Services shall be brought in the state or federal courts having jurisdiction in Laramie County, Wyoming, United States.

Nothing in this section limits mandatory consumer protection rights available under the laws applicable to a customer’s place of residence.
